About Damian Falkowski, commercial and propertyDamian Falkowski has nearly 30 years’ experience as a barrister specialising in commercial and property disputes. In recent years, he has been involved in numerous cases for tech and crypto companies. These have included shareholder and investor disputes and cases concerning alleged infringement of intellectual property rights in code.
He has acted for corporations large and small, partnerships and private individuals. His most recent work has involved jurisdictions right across the world including Singapore, Bahamas, Isle of Man and USA.
He is regularly instructed in world wide freezing orders. He recently acted for a US hedge fund in a $100 million tracing claim obtaining freezing injunctions and Norwich Pharmacal orders. He was also instructed in a US $500 million international fraud tracing claim.
While most of his work is solicitor instructed, he also accepts instructions directly from clients. He is able to take a case from initial enquiry, through to the conclusion, whether that is by negotiation, mediation, arbitration or court process.
Damian has been General Editor of Halsbury’s Laws Consumer Credit and Aktins Court Forms: Mortgages. He is a contributor to the leading textbook on the law of evidence: Phipson on Evidence: Estoppels. Other text books include A Practical Guide to The Landlord and Tenant Act 1954: Commercial Tenancies, the 3rd Edition of which will be published in the autumn.
He has been admitted to practise as a barrister of the Eastern Caribbean Supreme Court in the Territory of the British Virgin Islands. He has considerable experience of alternative dispute resolution including expert determination and mediation.
He is on the Isle of Man register of Legal Practitioners, Legal Practitioners Registration Act 1986.
He is registered with the Bar Council of England and Wales.
