Damian Falkowski has more than 25 years’ experience as a barrister specialising in commercial disputes. He has acted for corporations large and small, partnerships and private individuals. While most of his work is solicitor instructed, he also accepts instructions directly from clients. He is able to take a case from initial enquiry, through to the conclusion, whether that is by negotiation or court process and ultimately enforcement by execution of judgment and contempt of court proceedings. He is frequently instructed to obtain urgent freezing injunctions in order to preserve assets and prevent removal of assets from the jurisdiction. He has recently acted for a US hedge fund in a $100 million tracing claim obtaining freezing injunctions and Norwich Pharmacal orders. He was also instructed in a US $500 million international fraud tracing claim. He has obtained injunctions to prevent trade in breach of exclusivity agreements, and to restrain the inducing of breach of contract. His commercial practice includes joint ventures, charges and guarantees, consumer credit, secured and unsecured lending and share sale agreements. He is regularly instructed in cases involving disputes concerning financial trading platforms, financial regulation and blockchain.
